Frequenty Asked Questions
Am I eligible to make a claim?
If you have been injured in an accident that was not your fault or you were only partly to blame, then you are eligible to claim for compensation against the at fault party. The law is on your side with the intention of awarding you damages to put you back into a position where the accident had not occurred. You can therefore claim damages for
any personal injury;
any rehabilitation treatment necessary to aid your recovery;
any undue expenses that you have incurred, for the damage to your bike and kit;
any loss of earnings
We always work on a no-win no-fee basis and offer free advice on all cases. If you have any doubt, give our cycle team a call or request a free call back.
How do I start my claim?
Starting your claim with Bike Injury Solicitors is a quick and straightforward process. Our bike injury experts will take the hassle out of your personal injury claim. Upon contacting our team we will give you a fair and honest assessment of your case. We will inform you of the relevant law and take the hard work out of starting a claim. We will then work with you throughout your case to ensure that we are on hand, every step of the way.
How does ‘No Win No Fee’ work?
No win no fee is a phrase used a great deal, when referring to a claim for damages and is seen in a negative light.
However “No win no fee” simply refers to the funding agreement you enter into with Bike Injury Solicitors when instructing us to start a claim on your behalf.
The ‘No win no Fee’ term means that if your claim is not successful, and providing you have cooperated fully with your legal team, you will not have to pay a penny towards the legal costs incurred by Bike Injury Solicitors.
What can I claim back after a bike accident?
If you have been involved in a cycling accident, we will help you make a claim for injuries, damage and losses suffered as a result. We can help even if you maybe partly to blame. If the accident was with another vehicle, the claim will be pursued against the driver’s insurance company. If it was caused by a driver who was was not insured or a hit and run driver, we will help you make a claim through the Motor Insurers’ Bureau. Alternatively if it was as a result of a defect in the road, cycle track or path, you may be able to recover compensation against the local authority or landowner.
At Bike Injury Solicitors, we offer free initial advice and guidance. We will advise you about the claims process, the law which applies to your individual accident circumstances and exactly what you are entitled to recover. We will ensure all your losses are included as part of your claim.
Below is an example of what we can help you recover. Please note this is not an exhaustive list and you may have suffered other losses specific to you. Bike Injury Solicitors will always help you recover all losses which you have suffered following your accident.
I don’t have the other driver’s details?
It is often possible for us to trace the other driver and their insurance company from very limited information.
Also, the police may be able to assist and we are able to contact them on your behalf if required.
If the case was a hit and run, or the driver was not insured, then we can usually still pursue a claim on your behalf through an organisation set up to compensate such victims (the Motor Insurers Bureau).
If you have been injured by a hit & run driver or the driver of the vehicle does not have insurance contact our specialist team for advice.
How long do I have to make a claim?
Adults (over 18 years old) normally have three years from the date of an accident to begin a compensation claim.
Children under the age of 18 have three years from the date of turning 18.
However, there is no time limit for people who don’t have the mental capacity to make legal decisions, which often applies to those who have suffered serious brain injuries.
In fatal cases, the family of the deceased has three years to make a claim, starting from either the date your loved one died, or the date you received the post-mortem results.
If your accident or injury happened outside of the UK, then the time limit can be shorter. If this is the case, it’s vital that you contact Bike Injury Solicitors as soon as possible.
If you have any concerns or questions about the time limit for claiming compensation, call our specialist team today on 0330 133 1214 for free initial advice and to talk through your options.
How much compensation can I expect to recover?
How much compensation you can expect to receive following a cycle accident will depend on a number of factors related to your injury, its circumstances, and the support and rehabilitation you require as a result.
The amount of compensation you could claim is based on:
The level of your pain and suffering
How long it will take you to recover
Whether or not the recovery is complete
Current and future loss of earnings
Medical and travel expenses you have incurred
Your care and support needs – both now and in the future
The cost of any modifications to your home
If you wish to find out more call us on 0330 133 1214 to discuss your personal circumstances, and we’ll be happy to discuss your options in a free initial consultation.
Do I have to go for a medical examination?
Generally, yes, if you are claiming for compensation or losses because of injuries. We will ask you for full details of your injuries and obtain your medical notes in order to choose the best doctor to properly assess your injuries.
The examining doctor will provide us with a full report on your injuries and we will then be able to advise you on the expected level of compensation.
Will I have to attend court?
This is highly unlikely. Only a very few case go all the way to a court hearing. Most cases will settle when the insurers make an acceptable offer after negotiation with us.
If your case does go to court and you are required to attend you’ll find we’ll give you all the support you need.
Can I get an early compensation payment?
Early compensation payments, also known as interim payments, are made in advance of any final settlement. They’re only made in an agreement with your opponent, if they admit that they’re responsible for your injuries.
Interim payments can be used to replace loss of earnings, so you can afford to pay essential bills if your injury has meant you’ve been absent from work, as well as covering the cost of specialist medical care or mobility equipment.
We’ll work hard to get an early admission of fault, and also to obtain early compensation payments to relieve any immediate pressures you’re feeling.
